Employee Rights

Pension & Retirement Benefits

Strict laws and regulations govern employee benefits. However, in a changing economy, workers on all levels must be vigilant in order to obtain or protect hard-earned employee benefits.

L&N has represented thousands of Plan participants and beneficiaries in connection with claims to maintain and recover Plan benefits. We have recovered large monetary awards and settlements in righting the wrongs committed by Plan sponsors and administrators for committing misconduct or fraud. In addition, we know ERISA (the Employee Retirement Income Security Act) inside and out.

Health Insurance

Employees are all too often promised in company handbooks or through collective bargaining agreements and other written documents that they will receive lifetime health insurance benefits. However, these promises conveniently melt away later after these employees have left employment and are forced to fend for themselves when health insurance coverage can no longer be obtained or is not affordable.

Unlike other law firms, L&N has the technical expertise in understanding federal and state statutes to determine quickly whether those benefits are protected and to advise clients of their rights. As a result, we have litigated class and individual actions successfully over health insurance losses and reductions.

The goal of these insurance company tactics is to terminate benefits or to “strong-arm” an unfair claim settlement.

With our wealth of experience in this unique area, we quickly can negotiate settlements or restorations of denied benefits, often without the expense and delay of litigation. Other times, we have fought aggressively in court for our clients to obtain what they deserve. Many years of handling complex disability insurance issues have given us the unique perspective, litigation skills and trial strategies needed to secure damages for income disability claim denials.

False Claims & Whistleblowing

State and federal whistleblower laws are designed to encourage employees to come forward to report corporate misconduct. Often, the laws provide for protections for the “whistleblower” and allow for the reporting person(s) to obtain significant financial recoveries if attacked or dismissed by their employer.

Having represented a number of whistleblowers over the years, L&N’s attorneys are skilled at investigating and developing the facts necessary for a client to maintain a successful action. Due to our highly focused practice, we can devote significant resources and time to each whistleblowing case we accept.
